ST. LOUIS/EWORLDWIRE/Feb. 14, 2008 --- Tuesday a federal jury in Marshall, Texas, found that Boston Scientific Corp. infringed a patent on drug-coated stents and awarded the inventor $431.9 million. According to an analysis performed by LegalMetric, a St. Louis-based data mining firm, the probability of that verdict being upheld through appeal is around seventy percent (70%).

LegalMetrics analysis includes determining the historical probability that the Judge assigned to the case would overturn the verdict and determining the historical probability that the court of appeals would overturn the trial court judgment. The trial judge in this case, Federal Judge T. John Ward of the Eastern District of Texas, grants motions to overturn trial results less than fifteen percent (15%) of the time. On appeal, Judge Ward is affirmed in roughly eighty percent (80%) of his patent cases. Based upon Judge Ward's history in patent cases, the probability of this verdict being upheld through appeal is seventy-one percent (71%), according to LegalMetric.

LegalMetrics study also found that Boston Scientific historically loses three out of five patent cases in which it is a party.
